 :: In one of the latest cases arising from the sub-prime problem ( In the matter of Merrill Lynch, Pierce, Fenner & Smith Inc & Ors), the “Enforcement Section of the Massachusetts Securities Division of the Office of the Secretary of the Commonwealth” (apparently with the locus standi conferred by MUSA) filed a Complaint dated 1 February 2008 against a Merrill Lynch entity, alleging among other things, “inappropriate and illegal” sale (through Merrill Lynch’s agents) of “certain esoteric financial instruments known as Collateral[sic] Debt Obligations”.

 :: Two 'sub-prime' related complaints were filed in quick succession in early January 2008. The first one (Mayor and City Council of Baltimore v Wells Fargo) was dated 8 January 2008 and filed by the Mayor and City Council of Baltimore against the Wells Fargo Banks and a related company for, inter alia, failing to prudently underwrite HARMs.
The second City of Cleveland v Deutsche Bank Trust Company & Ors was filed with the Court of Common Pleas, Cuyahoga County, Ohio, on 10 January 2008, the plaintiff, the City of Cleveland, alleges that a long list of prominent Wall Street and international banks, including Goldman Sachs, Merrill Lynch, Credit Suisse, Bear Stearns, Citigroup, HSBC, J P Morgan, Lehman Brothers, Morgan Stanley, are responsible for the sub-prime mortgage foreclosure crisis. new!

 :: Barclays Bank Plc v Bear Stearns Asset Management Inc & Ors: In a 341-paragraph Complaint filed at the US District Court, the Plaintiff Barclays Bank claimed a long list of wrongdoings including fraud, misrepresentation, conspiracy, breach of fiduciary duties and duties of care and promissory estoppel (para. 23).
